Publication of "Example cases of approval/denial of special permission to stay in Japan"

While the Immigration Services Agency has previously published sample cases for the approval/denial of special permission to stay in Japan in order to increase transparency and predictability regarding such judgements, a new version was released this year using samples from the previous year.

1. Background

The Immigration Services Agency has been publishing sample cases from 2004 onwards that they may help in establishing guidelines regarding special permission to stay in Japan. In the interests of increasing transparency and predictability regarding such judgements, a selection of cases has been released from April 2010 onwards, neatly organized by division and category. This year also saw the publication of case samples taken from the previous year, similarly divided by type.

2. Major classifications

  1. Main divisions: where the spouse is a Japanese national; where the spouse is a foreign national (with a legitimate status of residence); foreign national family, etc.
  2. Main categories: motives, type of offence, length of residency, duration of offence, family configuration, detailed permissions, etc.

3. Other

From this year onward, sample cases are to be published yearly to ensure that appropriate decisions for special permission to stay in Japan are being made.
