Publication: "Sample cases for the approval/denial of special landing permissions"

While the Ministry of Justice has previously published sample cases for the approval/denial of special landing permissions in order to increase transparency and predictability regarding such judgements, a new version was released this year using samples from the previous year.

1. Background

Since the report on "The Future of Immigration Administration" was submitted to the Minister of Justice after the sixth Immigration Policy Roundtable was held in December 2014, requests regarding the approval/denial of special landing permissions were submitted across the board. In the interests of increasing transparency and predictability regarding such judgements, the Ministry of Justice published a selection of cases from March 2015 onwards, neatly organized by division and category. This year also saw the publication of case samples taken from the previous year, similarly divided by type.

2. Major Classifications

(1) Main divisions: where the spouse is a Japanese national; where the spouse is a foreign national (with a legitimate status of residence)
(2) Main categories: grounds for denial of landing, the number of years since deportation, the length of the marriage, the presence/absence of children, the presence/absence of criminal penalties, detailed permissions, etc.

3. Other

Sample cases are to be published yearly, from this year onwards, in order to ensure that the appropriate decisions for special landing permissions are being made.
